Terms and Conditions of Sale

Article 1 – Definitions

These terms and conditions of sale (hereinafter "Terms") are provided by DOLCENIDA.

The following definitions apply:

"Site": the website "https://dolcenida.com" and all its sub-pages, the exclusive property of the Company.

"Products" or "Services": all products (physical goods) and services (performances) that may be purchased or ordered on the Site.

"Seller": DOLCENIDA, the legal or natural person offering its Products or Services on the Site.

"Customer": the internet user, whether a natural or legal person, who purchases one or more Products or Services on the Site.

"Consumer": as defined by consumer law: "any natural person acting for purposes which are outside their trade, business, craft or profession."

Visitors to the Site interested in the Products and Services offered by the Seller are advised to read these Terms carefully, to print them and/or save them to a durable medium before placing an order on the Site. The Customer confirms that they have read the Terms and accept them in full.

Article 2 – Application of the Terms and Purpose of the Site

The Seller reserves the right to amend the Terms at any time by publishing a new version on the Site. The Terms applicable to the Customer are those in force on the date of their order on the Site.

Legal information relating to the hosting provider and administrator of the Site, the collection and processing of personal data, and the conditions of use of the Site, are set out in this Site's Terms and Conditions, Legal Notice and Privacy Policy.

This Site offers the online sale of home products.

The Site is freely and unconditionally accessible to all Customers. Purchasing a Product or Service requires the Customer to accept all the provisions of these Terms, thereby confirming that they have read them in full. This acceptance may take place, for example, by ticking the box stating "I confirm that I have read and accept all of the Site's terms and conditions". Ticking this box carries the same binding value as the Customer's own signature.

Acceptance of these Terms assumes that Customers have the necessary legal capacity to do so. If the Customer is a minor or lacks such legal capacity, they declare that they have obtained the consent of their guardian, curator or legal representative.

The Customer expressly acknowledges the evidential value of the Seller's automatic recording systems and waives the right to dispute them in the event of a dispute, unless proof to the contrary is provided. Every Product order assumes the Customer's unconditional acceptance of, and full consent to, these terms and conditions of sale, which take precedence over any other document: catalogues, advertisements, instructions, save for any express and prior agreement to the contrary made with the Company.

Article 3 – Customer Service

This Site's customer service can be reached by email at: contact@dolcenida.com, via the contact form, or by post at the address given in the Legal Notice. The Customer must include their first and last name, the subject of their request, and their order number in the email. For any professional enquiries (partnerships, media, contract proposals), the Company can only be reached by email at contact@dolcenida.com.

Article 4 – How to Order and Description of the Purchase Process

The Products and Services on offer are those listed in the catalogue published on the Site. Each product is accompanied by a description drawn up on the basis of information provided by the Seller's supplier.

Photographs on the Site have no contractual value and may differ significantly from the models photographed. These differences are due to variations between screen and camera settings, product lighting, camera angles, etc.

The "Basket" is defined as an intangible object which brings together all the Products or Services selected by the Customer on the Site with a view to purchase. To place an order, the Customer selects the desired Products and adds them to their "Basket", the contents of which may be amended at any time.

On the "Basket" page, the Customer can check the details of their Order and correct any errors before confirming it. On the "Details" page, the Customer must enter their contact details. On the "Delivery" page, the Customer must choose a delivery method. On the "Confirmation" page, the Customer must enter their payment details, billing address, and any discount codes.

The sale is deemed validly concluded once the Customer confirms their Order by clicking the "Complete order" button, accepts the Terms and Conditions of Sale, and makes payment using their chosen method.

Article 5 – Prices and Payment Terms

Unless otherwise stated, prices shown in the catalogue are given in pounds sterling, inclusive of all taxes (VAT included), and do not include any delivery charges. DOLCENIDA reserves the right to change its prices at any time. However, the price shown in the catalogue on the date of the order is the only price applicable to the Customer.

The Customer can pay by debit or credit card, Bancontact, Apple Pay or PayPal. This Site does not have access to the Customer's payment details. DOLCENIDA archives order forms and invoices on a reliable and durable medium.

Article 6 – Delivery

Delivery charges are communicated to the Customer before any payment is made. The Site applies no geographical delivery restrictions; orders can be shipped worldwide. Delivery times given at the time of order are indicative only.

For deliveries outside the United Kingdom, the Customer declares themselves the importer of the Product and accepts that the Seller may not always be able to provide precise information on customs duties.

The Seller undertakes to deliver the Products within a maximum of thirty (30) days from the conclusion of the contract. Exceeding this timeframe may result in the sale being cancelled at the request of the Consumer Customer, who will be refunded within fourteen (14) days.

If a shipment is returned to the Seller, the Seller will contact the Customer to ask how they would like to proceed with their order. A re-delivery will require payment of new delivery charges.

Article 7 – Right of Withdrawal and Withdrawal Form

The Consumer Customer has fourteen (14) calendar days from the date of receipt of the product to withdraw from the contract, in accordance with UK consumer rights legislation. The product must be returned in perfect condition, in its original packaging and unused. The Customer is responsible for return shipping costs.

The refund will be made using the same payment method as the original transaction, within a maximum of fourteen (14) days of receipt of the returned Product.

Article 8 – Product Guarantee

The statutory guarantee of conformity applies, regardless of any commercial guarantee that may be granted. In accordance with the Consumer Rights Act 2015, the Seller is responsible for any lack of conformity present at the time of delivery of the goods, which becomes apparent within six (6) years of delivery (England and Wales) or five (5) years (Scotland), subject to the specific short-term rights below.

Where goods are faulty, the Customer may be entitled to a repair, replacement, price reduction, or refund, depending on how long they've owned the goods (in particular, a short-term right to reject within the first 30 days). Where the delivered Product is not of satisfactory quality, it may be returned to the Seller, who will arrange for its replacement or refund. Return costs in this case are borne by the Seller.

Article 9 – Liability

DOLCENIDA is not liable for failure to perform the contract due to force majeure, nor for any indirect losses suffered by the Customer. The choice and purchase of the Product are the Customer's sole responsibility. DOLCENIDA cannot be held liable for malfunctions, unavailability of the Site, or the content of external links.

Article 10 – Force Majeure

Events beyond the control of the parties which entirely prevent the performance of contractual obligations are considered force majeure. After ninety (90) calendar days, the Order may be cancelled by either party by recorded delivery letter.

Article 11 – Intellectual Property Rights

All elements of the Site are protected by copyright, trademark and patent law. Reproduction or distribution of the Site's elements without the Company's written consent is prohibited. DOLCENIDA's trademarks and logos are protected under applicable intellectual property law.

Article 12 – Processing of Personal Data

The Company collects Customer data for the purposes of processing orders, managing customer relations, and developing the Site. Data is retained for a maximum of five (5) years. In accordance with the UK GDPR, the Customer has the right to access, rectify, delete or object to the processing of their data by email: contact@dolcenida.com.

Article 13 – User Comments and Other Suggestions

By submitting comments, the Customer grants DOLCENIDA the right to use them at any time and without restriction. The Customer undertakes not to publish unlawful, offensive or defamatory content and is solely responsible for their comments.

Article 14 – Severability Clause

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain valid. These Terms supersede any prior agreement. All correspondence relating to these Terms must be conducted in English.

Article 15 – Governing Law and Dispute Resolution

These Terms are governed by the law of the country in which the Seller is established. Customers may also refer disputes to an alternative dispute resolution (ADR) provider approved by the Chartered Trading Standards Institute; details can be provided on request. Dispute resolution is free of charge for the Customer. The Site reserves the right to take legal action against any attempted fraudulent purchase.

Partial guarantee: the guarantee is limited to 30 days from the date of purchase under normal conditions of use. The Seller undertakes to replace the faulty part.
